This Privacy Notice sets forth the privacy practices of the Texas Municipal League Intergovernmental Risk Pool (Risk Pool) with respect to data it collects, maintains, and uses.
I. Who is the Risk Pool?
The Risk Pool is an administrative agency and governmental entity in Texas, created under the provisions of Chapter 791 of the Texas Government Code, Chapter 2259 of the Texas Government Code, and Chapter 504 of the Texas Labor Code, all of which allow local governmental entities to jointly self-insure for various risks and liabilities. The Risk Pool administers the self-insurance program created jointly by its member governmental entities, all of which are political subdivisions of the State of Texas. In administering the self-insurance program, the Risk Pool provides workers’ compensation coverage and various liability and property coverages.
II. What types of data does the Risk Pool collect, maintain, and use?
The Risk Pool collects, maintains, and uses the following types of data:
- Personal data
- Sensitive data
- Health data
- Medical data
III. Why does the Risk Pool collect, maintain, and use the various types of data above?
The Risk Pool administers the self-insurance program of over 2,800 local governmental entities in the State of Texas. As such, it must collect, maintain, and use data, including sensitive data, to administer and handle claims and litigation made against its members. The Risk Pool collects, maintains, and uses your data solely for these governmental purposes.
IV. Does the Risk Pool share any of my data with third parties?
The Risk Pool only shares data with third parties to accomplish its objective of administering the self-insurance program of Texas local governmental entities. This can include sharing data with outside attorneys hired by the Risk Pool to represent its members in claims and litigation, and with medical personnel hired to assist with the handling of workers’ compensation claims. Both are required to maintain confidentiality of your data. Further, the Risk Pool contracts with certain information technology companies to assist with its collection, maintenance, and use of your data. Such companies are legally and contractually required to maintain the confidentiality of your data the same as the Risk Pool. Finally, the Risk Pool may, on occasion, be directed through legal processes such as subpoenas and court orders to share your data with third parties. The Risk Pool does NOT sell your data. The Risk Pool does NOT use your data for advertising or targeted advertising.
